Fortnite insists it wasn’t stitched up by Warner Bros. and the Peacemaker emote, but is modifying it anyway ‘to avoid any confusion’

Last week, Fortnite pulled the Peaceful Hips emote—which recreated a portion of the opening dance in James Gunn’s DC show Peacemaker—after the latest episode’s bombshell completely changed the context around the movement.

After Epic said it would “inquire into our partner’s creative intentions in this collab emote,” it’s now determined that Warner Bros. most definitely was not trying to stitch the developer up. But, you know, it’s changing the emote anyway. Just to be safe.

The Peaceful Hips emote was added to the Fortnite store earlier in September, before being promptly removed just a few days after Peacemaker’s sixth episode of its second season aired. The reason? Well, the episode revealed a pretty major plot twist: John Cena’s character has been milling around in a seemingly-perfect alternate universe… which turned out to be an America that lost to Germany in World War 2. An all-white America, a swastika in place of the American flag’s stars. A Nazi utopia, essentially.

The revelation gave some rather damning new context to the goofy dance number Peacemaker performs in the show’s opening—at one point, he’s seen flapping his arms in a way that could be perceived as resembling a swastika. More importantly, the move seems to be an exact replica of one performed by Donald Duck in the anti-Nazi propaganda short film Der Fuehrer’s Face from 1942.

That also happens to be the exact snippet used for the Peaceful Hips emote. You see the problem here.

Now, in a follow-up post, the Fortnite Status X account wrote: “We’ve worked closely with our partners at Warner Bros. Games to confirm there were no creative intentions to connect the Peaceful Hips emote and the current Peacemaker storyline. To avoid any confusion, we’re modifying the Emote choreography in next week’s update.” Epic says that players who purchased the emote prior to its removal are free to return it without spending any refund tickets.

Presumably the updated emote will take a slightly less damning portion of the dance, while still being from the second season’s choreography.

Ultimately it’s probably the best move for Epic, even though the response as to whether it’s a necessary move is mixed. Removing the implication entirely is likely to save the developer a massive headache—and even if that wasn’t the emote’s intention, it was most certainly going to be exploited in that manner. Will that go away even after an alteration? Who knows

Warner Bros., DC Comics and More Sue Midjourney, Says AI Firm ‘Thinks It Is Above the Law’

Warner Bros. Discovery on Thursday filed a copyright infringement lawsuit against AI image and video company Midjourney, making it the third major entertainment company to do so following Disney and Universal’s similar lawsuit filed earlier this year. 

The lawsuit alleges the AI company violated the entertainment company’s copyright protections by allowing AI users to create images with characters like Batman, Scooby Doo and Bugs Bunny.

“Midjourney thinks it is above the law,” Warner Bros. Discovery said in the complaint. “Midjourney has made a calculated and profit-driven decision to offer zero protection for copyright owners even though Midjourney knows about the breathtaking scope of its piracy and copyright infringement.”

Midjourney is one of the most popular AI image generators, allowing anyone to create AI images and video clips with simple text prompts. The lawsuit covers Warner Bros. Entertainment and its subsidiaries, including DC Comics, The Cartoon Network and Hanna-Barbera Productions.

In the lawsuit, Warner Bros. Discovery notes that Midjourney recently dropped a video generation model as evidence that the AI firm knew it was infringing on copyrights. In the first few days of releasing the video model, the lawsuit alleges, Midjourney stopped users from animating scenes with characters. The restrictions were eventually lifted, but the entertainment giant calls this out as Midjourney’s knowledge of wrongdoing. Warner Bros. Discovery also alleges the AI company updated its terms of service to prohibit redteaming, a safety process tech companies use.

Copyright infringement claims aren’t new for Midjourney. In June, Disney and Universal sued the AI program, calling it “a bottomless pit of plagiarism” and “textbook copyright infringement” in its filing. Warner Bros. Discovery is represented by the same law firm that filed the suit on behalf of Disney and Universal.

A Warner Bros. Discovery spokesperson told CNET, “The heart of what we do is develop stories and characters to entertain our audiences, bringing to life the vision and passion of our creative partners. Midjourney is blatantly and purposefully infringing copyrighted works, and we filed this suit to protect our content, our partners, and our investments.” Statements from Disney and NBCUniversal spokespeople expressed similar sentiments. Midjourney did not immediately respond to a request for comment.

This lawsuit is further evidence that copyright is one of the most contentious legal issues in the age of AI. Concerns exist at every stage of AI content creation, including whether copyrighted materials are used to train AI models and whether those models can create content that meets the legal definition of infringement. 

There are also ongoing cases between publishers, creators and AI companies. AI-makers Anthropic and Meta recently scored two victories, with courts claiming that training their models on authors’ books constituted fair use. But there are still a lot of questions and legal uncertainties.

(Disclosure: Ziff Davis, CNET’s parent company, in April filed a lawsuit against OpenAI, alleging it infringed Ziff Davis copyrights in training and operating its AI systems.)

This is just step one for the lawsuit. Midjourney users shouldn’t expect any interruptions to service as a result of the legal battle.

Warner Bros. Shifts ‘Mortal Kombat II’ Release Date to Summer 2026

Johnny Cage (Karl Urban) will have to wait for showtime just a little longer than originally anticipated, as Mortal Kombat II will bow out of 2025’s fall movie release schedule, instead opening in May 2026.

The Warner Bros., New Line, and Atomic Monster production was originally slated to be released on October 24 of this year, but that is no longer the case. According to Deadline, it’s not a reflection of the film’s quality, as the trade reports the film has been testing well, but rather a pivot to bank on the success of the early summer window it saw with Final Destination Bloodlines. The New Line horror flick cultivated a solid box office debut of $51.6 million after opening in mid-May.

With that in mind, the sequel to 2021’s Mortal Kombat will now open on May 15, 2026.

The film stars Urban as Cage—a casting many have been anticipating since the first movie—and will feature returning stars Lewis Tan (Cole Young), Ludi Lin (Liu Kang), Jessica McNamee (Sonya Blade), Mehcad Brooks (Jax), Josh Lawson (Kano), Chin Han (Shang Tsung), Joe Taslim (Bi-Han), Tadanobu Asano (Lord Raiden), and Hiroyuki Sanada (Hanzo Hasashi and Scorpion). The ensemble is joined by newcomers Tati Gabrielle (Jade) and Adeline Rudolph (Kitana).

Crypto’s U.S. Policy Aims May Pivot on Resistance from Democratic Senator Warner

One of the crypto industry’s central lobbying aims — to protect software developers from being held legally responsible when criminals abuse their technology — may be in jeopardy from Democrats led by U.S. Senator Mark Warner, according to people familiar with legislative negotiations.

The Senate is set to return to work in Washington next week, with the completion of a crypto market structure bill as one of its top agenda items. In the bipartisan talks over that bill, Warner is said to have held reservations about the approach in the U.S. House of Representatives’ version of the bill known as the Digital Asset Market Clarity Act, which gave developers legal cover, according to three people with knowledge of the negotiation.

Warner, a Virginia Democrat who is the vice chairman of the Senate Select Committee on Intelligence, maintains a close focus on national security issues, and he’s said to have balked at the rampant hacks and money laundering concerns that he’s associated with the decentralized finance (DeFi) end of the crypto sector. In the past, he’s raised objections over reports that cryptocurrency may have been used to move assets to terrorist groups, and he pushed a bill in 2023 that looked to saddle DeFi platforms with the same anti-money laundering (AML) requirements that traditional finance firms must meet — a potentially existential threat to the way the decentralized projects operate without core management.

Back then, Warner said such an effort would “help maintain the robust AML and sanctions enforcement we need to protect our national security, while allowing participants who play by the rules to continue to take advantage of the potential of distributed ledger technologies,” additionally noting his views that “criminals and rogue states continue to use crypto to launder money, evade sanctions, and conceal illicit activity.”

Then he pursued an appropriations provision last year that would have automated a process to sanction “foreign digital asset transaction facilitators” – including crypto exchanges – linked to users who support terrorism groups. So he has a background in seeking to hold digital assets insiders responsible for the illicit use of their products.

A spokesperson for the senator didn’t immediately respond to a request for comment on his position in the latest negotiations, but Republican senators have been seeking to fast-track the Senate’s market structure bill, trying to follow the House in a wide, bipartisan approval.

Warner is among the Democrats on the Senate Banking Committee — one of the two panels that needs to come to agreement on the crypto legislation before it can move on to a floor vote.

Unlike with the more aggressive stance of fellow Democrat Senator Elizabeth Warren, the industry generally sees Warner as a member with a balanced view on crypto issues, having supported the sector in previous votes, such as in the recent passage of the bill to regulate U.S. stablecoin issuers — still standing as the industry’s biggest achievement in Washington. Digital assets political organization Stand With Crypto gives him an “A” grade as a lawmaker who “strongly supports crypto.”

When the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act was still moving through the Senate before its passage by a wide margin in June, some Democrats had halted the process on that bill to object to security and illicit-finance aspects of the industry (in addition to the potential conflicts posed by President Donald Trump’s own stablecoin business interests.) The disagreements were kicked down the road in favor of an easy passage of that earlier bill, with the knowledge that this market structure legislation would be a better place to hash out those concerns.

That debate is now arriving for the bill that’s the lynchpin of the digital assets sector’s Washington plans. This legislation to set out tailored regulations for U.S. crypto transactions is seen as necessary for the industry to come into its own and to bring remaining institutional players and hesitant retail investors into the realm of digital tokens.

Behind closed doors, crypto lobbyists are wondering if Warner’s background in venture-capital work for technology firms will help them make a case for protecting software-writing innovators from legal liability. In light of cases such as Tornado Cash developer Roman Storm’s recent criminal conviction, the urgency to establish a shield is amplifying.
