Anthropic Scores Partial Victory in Copyright Case Over AI Training Data

AI firm Anthropic has won a key legal victory in a copyright battle over how artificial intelligence companies use copyrighted material to train their models, but the fight is far from over.

U.S. District Judge William Alsup found that Anthropic’s use of copyrighted books to train its AI chatbot Claude qualifies as “fair use” under U.S. copyright law, in a ruling late Monday.

“Like any reader aspiring to be a writer, Anthropic’s LLMs trained upon works not to race ahead and replicate or supplant them — but to turn a hard corner and create something different,” U.S. District Judge William Alsup said in his ruling.

But the judge also faulted the Amazon and Google-backed firm for building and maintaining a massive “central library” of pirated books, calling that part of its operations a clear copyright violation.

“No carveout” from Copyright Act

The case, brought last August by authors Andrea Bartz, Charles Graeber, and Kirk Wallace Johnson, accused Anthropic of building Claude using millions of pirated books downloaded from notorious sites like Library Genesis and Pirate Library Mirror.

The lawsuit, which seeks damages and a permanent injunction, alleges Anthropic “built a multibillion-dollar business by stealing hundreds of thousands of copyrighted books,” to train Claude, its family of AI models.

Alsup said that AI training can be “exceedingly transformative,” noting how Claude’s outputs do not reproduce or regurgitate authors’ works but generate new text “orthogonal” to the originals.

Court records reveal that Anthropic downloaded at least seven million pirated books, including copies of each author’s works, to assemble its library.

Internal emails revealed that Anthropic co-founders sought to avoid the “legal/practice/business slog” of licensing books, while employees described the goal as creating a digital collection of “all the books in the world” to be kept “forever.”

“There is no carveout, however, from the Copyright Act for AI companies,” Alsup said, noting that maintaining a permanent library of stolen works — even if only some were used for training — “destroy the academic publishing market” if allowed.

Judge William Alsup’s ruling is the first substantive decision by a U.S. federal court that directly analyzes and applies the doctrine of fair use specifically to the use of copyrighted material for training generative AI models.

The court distinguished between copies used directly for AI training, which were deemed fair use, and the retained pirated copies, which will now be subject to further legal proceedings, including potential damages.

AI copyright cases

While several lawsuits have been filed—including high-profile cases against OpenAI, Meta, and others—those cases are still in early stages, with motions to dismiss pending or discovery ongoing.

OpenAI and Meta both face lawsuits from groups of authors alleging their copyrighted works were exploited without consent to train large language models such as ChatGPT and LLaMA.

The New York Times sued OpenAI and Microsoft in 2023, accusing them of using millions of Times articles without permission to develop AI tools.

Reddit also recently sued Anthropic, alleging it scraped Reddit’s platform over 100,000 times to train Claude, despite claiming to have stopped.

Helldivers 2 Players Score Biggest Victory Yet But At What Cost

“The President of Super Earth has been killed in action by the Illuminate during the fall of Prosperity City.” That was the message that greeted Helldivers 2 players when they logged on last night in one last bid to repel their invading squid-like foes. Some truthers think the hit was inside job. When the dust settled Friday morning, the battle to save Super Earth was over and players had succeeded in winning the extraction shooter’s biggest showdown since it launched. Pus they got a new battle station to celebrate.

The Week In Games: Co-Op Bug Blasting And More New Releases

“The devastation wrought upon our home is immense,” read the latest in-game dispatch from Arrowhead Game Studios. “Only two Mega Cities remain standing: Prosperity City and Equality-on-Sea. The remainder have been vacated by the enemy, having suffered catastrophic damage at their hands.” New Major Orders are still pending, but in the meantime players get to vote on where to move the new DSS battle station that aided in the fight, and that provides extra military bonuses to Helldivers fighting on whatever planet it orbits.

For anyone who missed the last two weeks, a brief series of entries on the Galactic Map recaps the events from the Illuminate’s arrival and torching of Mars and other planets, all the way through players’ epic last stand to protect Equality-on-Sea (Helldivers’ version of Shanghai). A lot of creative military tactics were improvised and deployed to take down the massive invading Leviathan ships, and a wave of negative Steam reviews, purportedly from Chinese players angry, due to a potential mistranslation, about why they couldn’t seem to fully liberate Equality-on-Sea, appears to have subsided.

What happens next is anyone’s guess. Arrowhead Game Studios might take some time before kicking off whatever it has planned to let players catch their breath. Maybe the development team is lining up a revenge campaign, or maybe there’s still another shoe to drop and Super Earth isn’t quite in the clear after all. A new president? In this economy? Maybe they’re just an Illuminate plant after all, ready to control Super Earth from within. The beauty of Helldivers 2‘s fascist space satire is that nothing is ever quite out of the question.

May kicked off one of Helldivers 2‘s biggest balance patches and content updates in some time, including a new Warbond battle pass with additional melee weapons and the ability to level up and customize most of the shooter’s guns. I wouldn’t bet on any other big updates anytime soon. That said, Summer Game Fest is just around the corner and Arrowhead used host Geoff Keighley’s last big gaming showcase to announce the addition of the Illuminate to the fray. Who knows what’s in store for the second half of Helldivers 2‘s second year?

Victory For Binance: US SEC Decides To Dismiss Lawsuit

The US Securities and Exchange Commission (SEC) has voluntarily dismissed its lawsuit against Binance, the world’s largest cryptocurrency exchange on Thursday, May 29. 

This decision was revealed through a court filing in Washington, D.C., and marks a significant moment in terms of regulation for both the exchange and the broader cryptocurrency industry in the US.

SEC Ends Legal Battle With Binance 

The dismissal follows a joint stipulation signed by legal representatives for the SEC, Binance, and the exchange’s founder, Changpeng Zhao (CZ) Originally, the SEC had accused Binance of various violations, including artificially inflating trading volumes and diverting customer funds. 

Additionally, the regulatory body claimed that Binance failed to restrict US customers from accessing its platform and misled investors regarding its market surveillance capabilities.

The SEC’s lawsuit also alleged that the exchange “unlawfully” facilitated the trading of several tokens that previous leadership at the agency had classified as unregistered securities. 

New Administration’s Influence

These accusations contributed to heightened scrutiny of Binance during the agency and the White House’s previous administration under Gary Gensler and former President Joe Biden respectively, and raised concerns about regulatory compliance within the cryptocurrency sector.

The decision to dismiss the lawsuit comes amid ongoing discussions about the regulatory landscape for digital assets in the United States with President Trump contributing to notable changes in both legislation and key positions in the regulatory agencies. 

This development has been met with notable optimism, as it signals a significant shift in the US Securities and Exchange Commission’s approach to regulating cryptocurrency exchanges in the country under its new chair Paul Atkins.

Despite the news, Binance Coin (BNB), the exchange’s native token, still records losses of 1.4% in the 24-hour time frame, trading at $675 per token.

Eagleopolis has fallen despite Helldivers 2 players slapping up 2.5 billion squids for an opening victory in the battle for Super Earth, leaving six Mega Cities to defend

Do you want the good news or the bad news first? Well, good news, Helldivers 2 managed to win the first major order of the battle for Super Earth by slaughtering over two billion Illuminate. The bad news? It’s not stopped Eagleopolis from falling.

As it turns out, not even the biggest number of Helldivers the game’s had since last spring diving in to help try and hold off the invasion of fresh Illuminate baddies was enough to stop one of Super Earth’s seven Mega Cities being reduced to ruins. It’s ok, don’t cry. Hug your SEAF buddy and watch a clip of someone surfing on a Leviathan if that’ll help.

The previous major order, which was the Helldivers’ initial defense of Super Earth after the Illuminate invasion of their home planet began with the arrival of the Heart of Democracy update, ended this morning. Things looked good, the goal of casually killing 2.5 billion Illuminate had been achieved. Let the good times roll right?

Nope, said Arrowhead. “Eagleopolis, a venerable stronghold of Managed Democracy since time immemorial, lies in ruins,” the studio informed us all via its latest MO briefing, “Its tattered shopping centers stand in warning as to the fate that awaits the rest of Super Earth, should our mission fail.”

So, that’s one of the seven Mega Cities which make up Super Earth destroyed, but there’s still a long way to go in the battle for Super Earth, and that win has seen folks make some progress towards wiping out the entire Illuminate fleet or forcing it to retreat.

Eagleopolis, a venerable stronghold of Managed Democracy since time immemorial, lies in ruins. Its tattered shopping centers stand in warning as to the fate that awaits the rest of Super Earth, should our mission fail.

“Illuminate Fleet Strength currently stands at 49%,” Arrowhead continued, “Six Mega Cities remain standing. The Helldivers must dig in, alongside their SEAF allies, and continue to fight, day and night, to defend the heart of our Federation. The surviving Mega Cities must be defended at all costs. The Helldivers must deploy to the Mega Cities as Illuminate pressure shifts among them to prevent them from falling. Once they fall, they cannot be reclaimed.”

Hence the latest order’s goal – successfull extract from missions against the Illuminate 20 million times, in order to strike a further blow to the fleet’s big invisible health bar. And, of course, to avenge Eagleopolis, which I’m sure people on the game’s subreddit would be cut up about if they weren’t too busy post fan art about loving their SEAF trooper buddies in a fashion that totally isn’t getting a bit creepy.

Epic CEO Tim Sweeney takes his victory lap as Fortnite returns to the app store after nearly 5 years: ‘Thanks to all of the folks who initially sided with Apple then later came around to the winning side’

After a protracted legal battle, which is far from over, Apple has restored Fortnite to the US app store. Fortnite was removed in August 2020 after launching its own in-app monetisation system to bypass Apple’s in-app payment system and the 30% commission it charges.

This violated Apple’s terms, and led to a legal challenge from Epic Games, which accused Apple of operating the app store as a monopoly. Epic CEO Tim Sweeney was in an unsurprisingly ebullient mood at the news and thanked those who’d taken Epic’s side in the dispute which, as ever, he characterises as a fight for developer rights.

“Thanks to everyone who supported the effort to open up mobile competition and #FreeFortnite from the very beginning,” said Sweeney. “And thanks to all of the folks who initially sided with Apple then later came around to the winning side, supporting app developer rights and consumer rights.”

Apple has made no comment.

“This is a clear win for Epic Games,” games business professor Joost van Dreunen told the BBC. “Epic has effectively forced open a door that Apple and others worked very hard to keep shut.

“The industry has long tiptoed around platform gatekeeping, but this moment signals a shift in the balance. Creators and publishers will now have more leverage to challenge entrenched distribution models.”

Fortnite has been available on iOS in the EU since January. Apple is complying with the court order after it got absolutely slammed by judge Yvonne Rogers Gonzalez for an “obvious cover-up” in a ruling that left no room for doubt:

“This is an injunction, not a negotiation. There are no do-overs once a party willfully disregards a court order. Time is of the essence. The Court will not tolerate further delays. As previously ordered, Apple will not impede competition.”

That doesn’t mean this is the end: Apple is fiercely protective of its walled garden approach to the app store, which it argues is in consumers’ best interests, and of course has the money to fight this until the bitter end. And Epic Games may well be the David to Apple’s Goliath, but it happens to be an extremely deep-pocketed David with a pugnacious CEO that’s treating this fight like a holy calling.

“Apple lost the 2021 injunction appeal in 2024, and it’s final and unappealable,” says Sweeney. “Now there’s a new contempt of court decision, and Apple is seeking to stay and appeal it, but whatever happens, they’re still obliged to comply with the injunction and the law.”

Sweeney also put things in more Fortnite-y terms: “we back fam.”

Helldivers 2’s Galactic War arrived on Super Earth earlier today, with the Heart of Democracy update deploying the divers on their first missions to defend the mega cities of their home planet. So far, it’s all going down well with players, especially one new feature – the AI SEAF squads.

To be fair, you can see why. With the latest major order requiring folks to casually kill 2.5 billion Illuminate as they work to activate the cannons they’ll need to see off the squids’ invasion of the planet, every helping hand on Super Earth’s side is a welcome addition.

Before we get into all the SEAF love, Arrowhead CEO Shams Jorjani has made it clear this was the thing he was talking about when he teased something was coming to the game that would lead players to defecate in their drawers. Sticking his head above the pulpit in Helldivers 2’s Discord server not long after the update went live, the exec simply asked: “What’s the pant situation soldiers????”

“Evaporated” was one of the first responses he got.

Naturally, it’s the new biomes and big war twist that’ve done a lot of that evaportating, but if you take a look at the game’s subreddit right, you’ll find the AI SEAF squads folks can run into as they run ops on Super Earth getting a load of love.

Basically, they’re members of the Super Earth Armed forces you can find running around the streets and enlist to help you take on the Illuminate of you chuck out the right emotes. Naturally, if you drop a salute, they’ll salute back, and they can even be persuaded to follow you around. Depending on who you ask, they’re either surprisingly effective in combat – below is a clip on one helping someone take down an Illuminate Fleshmob – or just cannon fodder.

Players like them so much that there are already calls for Arrowhead to give us the ability to arm the SEAFers with support weapons, become bunker door opening buddies with them, and drop a Warbond that lets folks dress in their trademark blue armour.

As one player with the handle Excelsus328 put it: “I don’t care if they showed the SEAF dying to friendly fire in the trailer, anyone who shoots these soldiers gets the kick”. “Oh god, now I want an emote to sing [the] Super Earth anthem and have them sing it with us like in Earth Defense Force,” added another going by Deathzeis.
