SEC, FINRA Probe Crypto Treasury Firms For Unusual Trading

The US Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA) are reportedly investigating suspicious trading patterns in the shares of certain companies that have announced crypto treasury strategies.

SEC, FINRA Scrutinize Suspicious Trading Moves

On Thursday, The Wall Street Journal (WSJ) reported that financial regulators have reached out to some of the over 200 companies with Digital Asset Treasury (DAT) strategies after observing unusual trading activity in the days leading up to the announcement of their crypto treasury strategy.

People familiar with the matter told the news media outlet that the SEC and the FINRA have examined unusual trading moves in the shares of multiple unnamed companies that announced that they would adopt a DAT strategy this year.

Reportedly, the regulators have raised concerns in letters and conversations about “unusually high trading volumes and sharp stock-price gains” that preceded the announcement that these companies would make cryptocurrencies their core corporate strategy.

SEC officials have warned these companies about potential violations of Regulation Fair Disclosure, the WSJ sources alleged. As the news media outlet noted, the rule prohibits public companies from “selectively disclosing material, nonpublic information to investors, analysts, and other market participants who might trade on the information.”

According to some lawyers, these types of FINRA letters usually mark the start of serious investigations into insider trading. However, it remains unclear whether the financial regulators are pursuing enforcement actions against any of these companies or investors.

Former SEC enforcement lawyer and now SEC defense attorney David Chase told WSJ that “when those go out, it really stirs the pot. It’s typically the first step in an investigation. Whether it goes full, full length, it’s anybody’s guess.”

The sources noted that, in some cases, the secrecy of the DAT announcements can be compromised, leading to the unusual stock activity ahead of the official statements. Meanwhile, lawyers who have worked on crypto-treasury deals affirmed that information leaks can also harm pricing transactions.

“If the stock price is highly volatile in the days leading up to pricing a transaction, that could actually make it very difficult to agree on a price for the transaction and put it at risk of execution,” Justin Platt, a partner at law firm Goodwin, told WSJ.

Crypto DAT’s Momentum Continues

Over the past few months, the crypto treasury strategy trend, pioneered by Michael Saylor’s Strategy, has gained momentum, with 212 new companies announcing plans to raise hundreds of billions of dollars to launch DAT strategies, the WSJ noted, citing data from crypto advisory firm Architect Partners.

Throughout September, multiple companies have unveiled crypto treasury strategies focused on Cardano (ADA), Avalanche (AVAX), and Solana (SOL). As reported by Bitcoinist, Solana-focused DATs have seen hundreds of millions of dollars invested in the strategies this month.

Recently, Helius Medical Technology revealed the launch of a $500 million SOL treasury strategy backed by Pantera Capital and Summer Capital. Similarly, Nasdaq-listed Fitell Corporation, a global provider of fitness equipment and health solutions, has unveiled the launch of the first Solana-based digital asset treasury in Australia.

Meanwhile, the top crypto treasuries have continued to accumulate Bitcoin (BTC) and Ethereum (ETH), the leading digital assets. BitMine, the largest ETH-focused treasury, recently surpassed the 2 million ETH milestone, while Strategy, the leading Bitcoin and crypto treasury, purchased another 850 BTC earlier this week.

Borderlands 4 Stuttering On PC? Gearbox Has An Unusual Step To Fix Stability Issues

The newest Borderlands 4 patch arrived on September 25, addressing stability and performance issues. The update doesn’t fix everything, though, and now developer Gearbox has given players some advice about how to addresses ongoing stability issues.

The developer said it’s aware of players experiencing stuttering issues following installation of the new update, impacting performance. This is due to shader compilation that’s occurring in the background during gameplay, which it said should clear up after 15 minutes of “continuous play.” That’s an unusual note, as shader compilation is typically handled during start-up, before you begin playing, in order to avoid just these sorts of issues.If the stuttering doesn’t clear up after 15 minutes, Gearbox advised clearing your shader cache, which is a process specific to your graphics card’s manufacturer.

Now Playing: Borderlands 4 Video Review

The technical issues with Borderlands 4 prompted Gearbox boss Randy Pitchford to post through it, but he’s since moved on to posting a lot about the upcoming Now You See Me movie sequel. Pitchford contributed to the magic elements of the movie and says he was more involved with that film that the Borderlands movie.

The September 25 patch for Borderlands 4 also added an FOV slider on console, which is something fans had asked for (and something that can reduce performance). The patch also made some balance changes to Vault Hunters, and even more are coming in another update that’s planned for next week.

In other Borderlands 4 news, the Switch 2 edition has been delayed indefinitely and all digital preorders are being refunded. Gearbox delayed the game to help add more polish and to support cross-saves.

We’ve been expecting today’s reveal, of course, ever since Activision confirmed back in July that Black Ops 7 would be part of Opening Night Live’s line-up this year. This is technically the game’s second “reveal”, because its first outing was at the very end of the Xbox Showcase back in June.

Today’s showcase was a lot more detailed, offering a look at gameplay that went beyond just a simple teaser of the game’s setting.

First things first, the leaked November release date turned out to be accurate. Black Ops 7 is set for launch on November 14. As for today’s reveal, its focus was mainly on the larger systems, features, and new mechanics arriving with the game. As previously announced, the co-op campaign (four-player) returns, but Treyarch is adding a pretty unusual twist to that.

The campaign’s final mission is what the developer calls Endgame, and it’s essentially a replayable, open-world section with some RPG and extraction elements. You get to customise your loadout and take on missions and other challenges within runs, where you can also level up and earn new abilities.

We also got a look at some of the futuristic weaponry we’ll be able to wield, and a few of the locations we’re going to be visiting. There’s a big emphasis on movement in Black Ops 7, which builds on Black Ops 6’s Omnimovement system with new possibilities, including the return of wallrunning.

Round-based Zombies is a core feature of the game, of course. This year, you can look forward to vehicle-based gameplay, as well as the return of Survival maps. Multiplayer was touched on, but the full reveal won’t arrive until Call of Duty: Next on September 30. There’s going to be a beta following that, too, taking place October 2-8.

Black Ops 7’s story takes place in the near future, a decade after the events of Black Ops 2. The game is the first consecutive Black Ops release in Call of Duty history, following last year’s Black Ops 6.

As beloved as the Black Ops name is, however, this year’s game faces tough competition in the form of Battlefield 6, a game whose beta has been breaking records throughout the month, overtaking even the most popular Call of Duty release on Steam.

There’s still a lot yet to be revealed for Black Ops 7, but community sentiment so far has been a lot more in favour of Battlefield 6 over it. Call of Duty rarely misses, though, and even with it does, it still manages to be the best-selling game in the year of its release.
