Alabama Lawmaker Raises Alarm On GENIUS Act’s Impact On Small Banks

Alabama State Senator Keith Kelley has warned that the GENIUS Act, signed into law on July 18, 2025, could trigger a wave of deposit outflows that would hurt rural community banks.

According to reports, Kelley set out his concerns in an op-ed for 1819 News, arguing that a perceived gap in the law could let crypto platforms offer yields or rewards that pull funds away from local lenders.

The warning comes as public comment periods have already opened at the US Treasury, and regulators are expected to write the rules that make the new law operational.

GENIUS Act: Senator Warns Of Deposit Flight

Financial experts say the worry centers on how “comparable supervision” will be defined. If foreign or nonbank stablecoin issuers are treated as having comparable oversight when regulators’ rules are loose, depositors could be tempted to shift cash to higher returns offered by crypto firms.

One estimate cited by banking groups puts potential deposit outflows as high as $6.6 trillion if the law is interpreted broadly. That number has made small bank leaders uneasy. They fear losing the stable deposits they use to lend to families, farmers, and local businesses.

A Rural Banking Crisis In The Making

Many community banks operate on thin margins. They rely on local deposits to underwrite loans for crop seasons, equipment purchases, and small shops.

Based on reports, Kelley warned that those lifelines could be weakened if large sums move to new digital products outside the traditional banking system.

Farmers and small business owners were named as especially vulnerable, because local lenders often offer terms tailored to seasonal needs.

GENIUS Act & Regulatory Path Ahead

The GENIUS Act is not yet in force in any operational sense. Implementation will depend on rulemaking by the US Treasury and the Federal Reserve, and those agencies have already asked for public input on the risks and anti-money laundering safeguards.

Reports have disclosed that some banking groups and lawmakers want tighter definitions and clearer guardrails before the rules are finalized. Supporters of the law argue it could bring more clarity to stablecoin markets, but opponents say that the details matter most.

If deposits start to leave, small banks could be forced to cut back on loans or raise rates to retain customers. That outcome would likely shift credit away from local borrowers toward larger financial centers.

Trump’s Crypto ‘Conflicts of Interest’ Are ‘Blocking’ Dem Legislation Support, Top Lawmaker Says

JACKSON HOLE, Wyo. — Despite growing bipartisan efforts to bring clear regulation to the digital asset industry, one main issue that stands in the way of passing legislation in the U.S. is President Donald Trump and his family’s actions in the sector, according to Rep. Angie Craig (D-Minn.)

“It’s no secret that my side of the aisle would prefer not to see any sitting President — I won’t name one — participating in this market while a sitting president unless those assets are in a sealed trust,” Craig said on stage at the SALT conference in Jackson Hole on Wednesday.

Trump, as well as his family, particularly Eric Trump, who was present at the venue during Craig’s appearance, have both built businesses in the industry, particularly since Trump retook office this past January.

Trump has issued several meme coins tied to his name and his social media platform, Truth Social, has applied for several exchange-traded funds. Eric Trump co-founded American Bitcoin, a mining company owned by Hut 8.

Craig, who was joined by Rep. Bryan Steil (R-Wi.), spoke on the Digital Asset Market Clarity Act which the House passed with a massive bipartisan vote last month. The Senate Banking Committee is working on its own version of crypto market structure legislation.

While the majority of Republicans are in favor of the bill, many Democrats remain skeptical, and a big reason for that is the Trump family’s involvement in the industry, Craig said.

“The elephant in the room here is the President’s family’s participation in this marketplace and that’s a stumbling block to get more Democrats to support the legislation,” she said.

Craig said that while there is some language in the legislation that limits this conflict of interest, a stronger tone is needed to convince some lawmakers.

“If we could find some language that would allow or prevent conflicts of interest to occur, from our perspective, I think you would see a whole lot more Democrats support it,” she said.

Craig is the ranking member on the House Agriculture Committee, meaning she is the leading Democrat on that committee. This isn’t the first time she’s referenced the Trump family’s crypto tie-ups — during a committee hearing in June on the Clarity Act, she said his crypto actions were “making this debate more difficult” and suggested that Congress should add restrictions on how the U.S. president can trade in markets overseen by the CFTC, including crypto.

Despite her comments, Craig still voted to advance the Clarity Act without any such language being added.

New York Crypto Tax Could Generate $158 Million a Year, Says Lawmaker

New York Assemblymember Phil Steck introduced legislation on Wednesday that would generate sweeping tax revenues from cryptocurrency transactions across the state.

Under Bill A0966, the Empire State would immediately impose a 0.2% excise tax on crypto transactions, using the proceeds to help schools combat substance abuse in upstate New York, where the opioid epidemic has severely impacted communities for years.

In a bill memo shared with Decrypt on Friday, Steck estimated that the levy would generate $158 million in annual revenue from “crypto investors [that] are driven by a single motive: the desire for quick and instant wealth.”

“The funding shall be used to expand the substance abuse prevention and intervention program to schools in upstate New York,” a separate description of the bill states.



Steck, a Democrat, chairs New York’s Standing Committee on Alcoholism and Drug Abuse, and the group oversees the state’s Office of Addiction Service and Supports, which serves over 730,000 individuals per year, according to an annual report. In 2023, 33 out of every 100,000 New Yorkers lost their lives to drug overdoses, the report notes.

The legislation comes as some states push forward with other crypto-related initiatives to assist schools as well, like Wyoming, where cash generated by the reserves of its soon-to-be-released stablecoin will get swept into the Cowboy State’s education fund.

As of 2023, cryptocurrencies like Bitcoin were treated as cash equivalents for tax purposes in New York, among seven other states, including California, according to Bloomberg Tax. A more recent tax guide from crypto accounting software firm Bitwave says that digital assets are already subject, like other assets, to capital gains tax, gift tax, and estate tax in New York.

In its initial form, the scope of Steck’s bill is broad, with tax implications for NFTs, digital assets obtained through mining and staking, as well as stablecoins, based on its text.

The New York Department of Financial Services, which regulates crypto firms through its BitLicense regime, would not provide Steck with data on the volume of crypto transactions, his memo notes. In a quarterly report, the regulator said it supervised 845 million transactions across 20 total institutions in 2024, but did not include the dollar amount.

The data likely doesn’t capture residents’ crypto transactions as well, so Steck found a workaround: He took the dollar-value of cryptocurrency that crypto analytics firm Chainalysis said was sent to the U.S. between July 2022 and June 2023, roughly $1 trillion, and adjusted that based on New York’s share of U.S. GDP in 2024, yielding $79 billion.

That number could be higher, with New York City serving as the epicenter of the financial world and home to a growing number of crypto-native firms like stablecoin issuer Circle, crypto exchange Gemini, and institutional firm Galaxy Digital.

Steck highlights scrutiny that the digital assets industry faced following the collapse of crypto exchange FTX in 2022, saying it has been “vulnerable to fraud and scams.” The memo lists Gemini, among other firms, as companies that were accused of defrauding clients.

Decrypt reached out to Gemini for comment, but did not receive a response.

New York State Attorney General Letitia James recovered $50 million worth of digital assets from Gemini through a settlement last year, after accusing the exchange of misleading investors about risks associated with its Earn platform.

In 2023, James brought a lawsuit against the exchange, bankrupt crypto lender Genesis, and crypto conglomerate Digital Currency Group for allegedly defrauding 230,000 investors out of more than $1 billion.

Steck’s memo also highlights the enormous amount of energy that computers consume when participating in the process of mining, or validating Bitcoin transactions, describing the environmental impacts of cryptocurrencies as “another downside.”
