There’s no “spyware” in Borderlands 4, Take-Two insist, following upset over terms of service

Gearbox and Take-Two Interactive’s Borderlands 4 has launched to cries of “pretty good” from (some) professional reviewers, and “Stutterland bugfest” from a vocal portion of the Steam playerbase. In amongst the complaints about performance, there are some fears about potential breaches of player privacy supposedly allowed for by Take-Two’s terms of service. A Borderlands developer has now responded to these fears in the Steam forums, reiterating that Take-Two at large aren’t in the business of “spyware”.

“Take-Two does not use spyware in its games,” reads the statement on Steam. “Take-Two’s Privacy Policy applies to all labels, studios, games, and services across all media and platform types such as console, PC, mobile app, and website. The Privacy Policy identifies the data activities that may be collected but this does not mean that every example is collected in each game or service.

“Take-Two identifies these practices in its Privacy Policy to provide transparency to players and comply with its legal obligations,” it goes on. “Take-Two collects this information to deliver its services to players, including to protect the game environment and player experience.”

The statement gives a couple of examples of more innocuous data collection, such as sponging up player and device identifiers to ensure compatibility with platforms, or making usernames visible to other players, together with more ambiguous practices like gathering data “to better understand how players play games”.

Take-Two have been caught deploying some pretty
insalubrious data collection software in the past. As reported by Alice O (RPS in peace) in 2018, Civilization 6 once made use of Red Shell software to track certain system data, in a bid to identify whether people who’ve clicked on adverts for games then proceed to buy them.

The Steam statement also seeks to clarify Take-Two’s policy towards mods, noting that they “prohibit mods that allow users to gain an unfair advantage, negatively impact the ability of other users to enjoy the game as intended, or allow users to gain access to content that the user is not entitled to”, but do not “generally” take action against mods “that are single-player only, non-commercial, and respect the intellectual property (IP) rights of [their] labels and third parties.” I’m not that familiar with the Borderlands modding scene, but Take-Two and subsidiary Rockstar Games have a legendarily iffy relationship with GTA modders.

As reported by Perignon Champagne Gamer, the concern about Take-Two spyware in Borderlands games dates back at least to May this year, when a Youtuber video about the publisher’s recently revised TOS sparked a short-lived uproar.

I do not want to hand over any of my data to any particular large corporation, myself, but I have to say, I don’t see anything in that TOS that strikes me as out of the ordinary, for better and worse. Suspicion is the appropriate response to such things, but exaggeration helps nobody. I’ve read a few comments that assume that Take-Two are automatically hoovering up everything mentioned in the list of possible data types collected, the second you boot up a game, rather than when you deliberately opt into certain services, such as Borderlands 4’s irritating SHiFT service for cross-play.

I am adding “interview somebody to do a proper explainer about data collection practices and privacy” to our endlessly extendable, usefully hypothetical Long Term Features trello. While we’re at it, we could look into related anxieties about anti-cheat and DRM, which have recently resurfaced thanks to Call Of Duty and Battlefield requiring that you enable secure boot on PC.

The TOS aside, some Borderlands 4 players are concerned about the game’s usage of two types of digital rights management – the infamous Denuvo software, which has been cited by a few of the reviews that mention launch performance problems, with proprietary Symbiote software stacked on top. We interviewed a Denuvo executive last year about their reputation for tanking games.

Borderlands 4 dev releases stability patch amid negative Steam reviews

Borderlands 4’s PC community has been vocal about poor performance since launch, and a new patch released on September 13, 2025, aims to address some of those complaints.

The game’s launch on Steam saw thousands of negative user reviews complaining about low frame rates, stutters, and crashes, even on high‑end hardware. These issues dragged the game’s overall Steam user rating down to “Mixed”.

September 13 patch seeks stability boost

A Gearbox blog post accompanying the update stated that the September 13 patch focused on improving stability across a wide range of PC configurations.

To help with smoother performance, Gearbox and 2K have also released optimization guides for NVIDIA and AMD users. Owners of the former were advised to ensure their drivers are up to date, and to follow recommended settings for their GPU and resolution. AMD users were given similar guidance.

While the patch does not yet appear to have solved all reported issues – negative reviews critcizing performance have continued to appear on Steam following the patch – many have already expressed cautious optimism that stability has improved.

Ahead of the release of Borderlands 4 last week, Conan O’Brien returned for a new episode of Clueless Gamer to try out the game in support of the non-profit Next for Autism.

Right out of the gate, O’Brien’s eyes seemed to glaze over while listening to the lore behind the game, joking, “Can you just say to people ‘these are robots’ and they go ‘PEW PEW PEW’?”

After getting through an opening cutscene he compared to a Russian novel, O’Brien met the infamous Claptrap and immediately joined the legions of gamers who hate the peppy little rolling box.

“You know what’s great about this little Claptrap guy? He’ll never get annoying,” O’Brien quipped. After mimicking the robot’s voice, he added, “He’s my least favorite trash can, and that’s really saying something.”

The great tragedy is that O’Brien could have muted the memetically hated robot companion thanks to a new option in Borderlands 4’s sound menu⁠—you really gotta hand it to Gearbox on that one, it’s a great bit. But perhaps for the sake of good content, O’Brien was forced to endure.

O’Brien then managed to take out some kratches and fought for his life during a trip to the Lambent Mines⁠—at least until the game crashed on him after co-host Aaron Bleyaert attempted to change a setting to make the game easier for O’Brien. After getting things back up and running, O’Brien spent a few minutes trying to figure out how to get through a forcefield (including just shooting at it, we’ve all been there) and took a stab at fighting the boss, “Vile Lictor.”

O’Brien managed a victory on the unfortunately-named honcho and closed things out by giving another shoutout to Next for Autism, which builds and runs programs to support people with autism. Of course, he also gives a shoutout to Borderlands 4, which is available now on Steam.

Borderlands games are all about chasing down rate loot, and for Borderlands 4, players can once again expect to plug in some Shift codes to grab an instant high-caliber upgrade. Borderlands 4 supports Shift codes, and the ones that can be redeemed for Golden Keys will let you open the unique Golden chests found in Belton’s Bore, The Launchpad, Carcadia, or The Lockaway.

How to redeem Shift codes

To redeem your Shift code, you’ll first need to create a Shift account on the Gearbox website. This is quick and easy to do, and you can then activate your Shift codes on the same website or via the in-game Social menu or via Borderland 4’s Social menu at launch. The other thing to note about Shift codes is that they typically have expiration dates, so it’s a good idea to redeem one as soon as possible.

From there, you can bank the rewards if they turn out to be Golden Keys, or splurge and use all of them to grab some new gear in one go.

One important note: The rewards contained within these chests scale to your current level, so you may want to consider waiting to use a Golden Key. Otherwise, using one early in the game will net you low-level gun as opposed to one you can use long-term.

The best Borderlands 4 PC graphics settings

Ready to shoot and loot until you can’t any longer? Borderlands 4 has arrived, and it’s brought some hefty visuals with it.

Gearbox’s latest FPS has some demanding settings when it comes to PC performance, so it may take some tweaking to get the game looking and running properly, especially if you have a somewhat older build like I do. I struggled early on until I figured out the right settings for my PC.

Thankfully, I now have the game running at a stable framerate, albeit with some sacrifice to visual quality. But trust me, you want BL4 to run smoothly as you are running, gliding, grappling, and driving around the new, awesome location of Kairos.

Here are my tips for the best PC graphics settings to use in Borderlands 4.

Best Borderlands 4 graphics settings

First, I would suggest using the Auto-Detect Graphics Preset to Run Auto-Detect within the game’s Advanced Visuals options to see what the game recommends for your PC. From there, it’s time to tweak settings up or down to get the best performance while also retaining fidelity.

If you’re having difficulties running Borderlands 4 at a smooth framerate, try out these settings:

  • General
  • Resolution Scaling
    • Upscaling Method: GPU-dependent
      • Use DLSS for Nvidia GPUs or FSR for AMD GPUs.
    • Upscaling Quality: Balanced or Performance
      • This was the single most important setting for me. Once I lowered it, I saw an immediate boost in general FPS and stability. Balanced will retain some visual fidelity while also helping with performance, but if you continue to struggle with frames, lower this to Performance or Ultra Performance at the cost of making the game a bit uglier. I do think it’s worth it when it comes to keeping your FPS stable.

Gearbox has released an optimisation guide for Borderlands 4 on PC, following reports of poor performance.


The latest in the series released yesterday, but so far has a Mixed response on Steam. One player has dubbed it “Stutterlands”.


While some players have had no problems at all, others have complained of “terrible optimisation” and advised others not to purchase until a fix is released.

Earlier this week, series creator Randy Pitchford responded to an article shared on social media, stating the game’s day one patch “does a lot”, but the game will be “unplayable” if using a below min-spec machine.


Still, it appears the day one patch isn’t sufficient for some players. And when the game already has a peak of over 200k concurrent players on Steam, that’s potentially a lot of people.

Gearbox has since released an optimisation guide for better performance using Nvidia GPUs, while re-sharing the minimum and recommended PC specifications.


The expected results for Borderlands 4 on PC are as follows:

  • Minimum PC specs – 1080p @ 30FPS with Low Preset settings
  • Recommended PC specs – 1440p @ 60FPS with Medium Preset settings


“Please note that any time you change any of your graphics settings, your shaders will need to recompile,” the guide reads. “Please keep playing for at least 15 minutes to see how your PC’s performance has changed.”


The guide then lists in granular detail the optimal settings for each type of Nvidia graphics card.


It should also be noted the game runs in Unreal Engine 5. Many recently released games using the engine – including Metal Gear Solid Delta: Snake Eater and Wuchang: Fallen Feathers – have been known to have performance issues.


However, Epic boss Tim Sweeney recently put blame on developers for engine issues, though more support is on the way.

By the end of this weekend, Borderlands 4 is probably going to be one of the biggest launches of 2025. It hasn’t gone off without a hitch, however. The game has been hit hard by negative reviews on Steam over its PC optimization. Now, Borderlands 4 has been accused of including spyware by some vocal fans online. Those rumors have been so pervasive that Borderlands 4 publisher Take-Two Interactive has already shared a statement denying them.

The issue at hand involves the kernel-level anti-cheat in Borderlands 4, which some have accused of being modified to collect data about players. Borderlands 4’s updated terms of service was also presented as evidence that the game was being used to spy on players, hence the response from Take-Two.

“Take-Two does not use spyware in its games,” wrote a company spokesperson on Steam. “Take-Two’s Privacy Policy applies to all labels, studios, games, and services across all media and platform types such as console, PC, mobile app, and website. The Privacy Policy identifies the data activities that may be collected, but this does not mean that every example is collected in each game or service.”

The company acknowledges that it does collect information about users “to deliver its services to players,” including personalization and compatibility options. Take-Two’s position is that it discloses this info in the terms of service to be transparent with fans.

PC Gamer noted that the latest furor over spyware stemmed from “a misleading YouTube video prompting fans to play a game of telephone about the changes to the EULA over Reddit and forum threads, and a bout of short-lived Steam review bombing that hasn’t accomplished much of anything.”

Similar concerns about older games from the company surfaced earlier this summer, which essentially received the same response from Take-Two as the latest allegations. The company also asserted that its updated terms allow it to go after “abusive mods” that don’t respect the intellectual property of the company, while allowing single-player non-commercial mods to be distributed freely among fans.

Some week, huh? Yeah. How about some video games? That’ll take our minds off things…well, perhaps not entirely. Our minds may still be trapped in this modern hellscape of our times, but games will hopefully give us hours of fun. And if you happen to find yourself with a comfy 48 hours of time off ahead of you but aren’t sure what to play, that’s where we come in with our recommendations.

Without further ado, let’s dive into what we’re looking forward to keeping ourselves busy with in the days ahead.

Borderlands 4

Play it on: PS5, Xbox Series X/S, Windows PCs (Steam Deck: “Unknown”)
Current goal: Loot more guns and kill more shit

I love all the Borderlands games. Yes, even 3, the one people hate for some reason. To me, the mix of gunplay, co-op, weird sci-fi, and endless killin’/lootin’ is a perfect mixture that rips away days or even weeks of my life in a flash. And Borderlands 4 is maybe my favorite one yet. (I’ve not written my full review yet, so we’ll see where I land in a few days.)

The gunplay and combat are better than ever, the loot is more balanced, the story is less annoying, and the open world is more rewarding to explore. It’s the next step forward for the franchise, and I’m scared of how many hours I’m going to lose to it. Especially as my friends get the game and I start running different characters and builds. – Zack Zwiezen

Hollow Knight: Silksong

Current goal: Die a lot while loving every second of the pain

I have spent an embarrassing amount of time on Hollow Knight: Silksong. Hopefully, goddess willing, I get to spend even more time with it this weekend.

I never played Hollow Knight, but with the sequel, I just got swept up in the collective excitement and let myself enthusiastically purchase a video game–and what a joy it’s been! This game is just beautiful, especially on a quality screen like the Steam Deck OLED’s. The sound design? Ugh, to die for. And the challenge? Well, yeah, that’s awesome too.

As a fitness coach said to me once as I was gasping for air from some ridiculous bullshit he was making me do, “easy things aren’t worth doing.” It was serious and funny at the same time, but the sentiment helped get me through the workout and many more since. There’s something valuable in that kind of experience. Let me elaborate.

Siliksong has been a hit in my local IRL circles. So many folks I know are playing it on their handheld devices and the difficulty, the challenge, the effort it takes to make progress in it have turned this game about strange little bugs into a gravity well of discussion. We empathize with the frustration someone feels when a boss smacks ‘em down for the seventh time in a row. Hearing that someone cleared a particularly hard thing sees folks offer genuine exclamations of “congrats!” Upon departing, we often wish each other “good luck,” referring to the tough challenges that lie ahead.

Are some challenges unnecessary? Maybe. Could there be tweaks that might make the game a touch fairer? Maybe. But at what cost? The runbacks you often have to undertake upon dying seem to be a part of the loop necessary to get you to collect your shards and restock on any beads you may have lost, plus that’s when you should be practicing your attacks! Boss fights aren’t when you should be still figuring out the physics of the diagonal downward strike.

Challenges can be exciting to think about and talk about with friends. A hard game demands attention, a set of skills for you to build into muscle memory and then use to satisfyingly pull off memorable feats. And when those elements are in a game as pretty as they are in Silksong? Those feats are all the more worth achieving. – Claire Jackson

Shadow Labyrinth

Current goal: Defeat the G-Hosts once and for all

This will probably be the last time I mention Bandai Namco’s strange and wonderful Pac-Man-adjacent Metroidvania here because I think I must be near its conclusion and I’m hoping to finally roll credits on it this weekend. This game, which I purchased thinking it might be a pleasantly nostalgic off-kilter diversion that took me 15 hours or so, has proven to be the most captivating game I’ve played all year, uncompromisingly committed to its vision and far more expansive than I anticipated. It’s decidedly “not for everyone” (what game is?) but if you’re open to being thrown into a world that makes itself deliberately hard to understand for many hours and you have any interest in the lore and history of early arcade games, consider getting lost in this maze for a while. – Carolyn Petit

Sword of the Sea

Play it on: PS5, PC
Current goal: Get the Platinum trophy

Sword of the Sea is this year’s Journey and I’m surprised more people aren’t talking about it. Developed by the thatgamecompany alum who cofounded Giant Squid (the indie team behind 2020’s PS5 launch game The Pathless), Sword of the Sea is another beautiful platforming adventure that’s more about cool traversal than interesting friction. You surf across snow, sand, and water like a weightless train gliding along magnetic rails as you collect seeds to bring life back to the ghostly environments.

It’s very short–only two or three hours unless you’re going for a completionist run–and not too demanding. It’s a brief but beautiful adventure that is content to let you have fun performing simple but satisfying tricks on your hoverboard as you shred across dunes and waves. The music and visuals are excellent, the feel of the gameplay is top-notch, and it’s free with PS Plus. I’m not sure if it will make my top 10 list but the experience packs so much evocative energy into such a short runtime there’s no excuse to not give it a try. – Ethan Gach

2XKO

Current goal: Figure out what the hell I’m doing

I’m not a League of Legends person. I never even finished watching Arcane despite it being very much my shit. But an invite to the 2XKO beta test just landed in my lap, and I love fighting games, so here I am. I only know, like, two of the characters in the roster, so I have zero perception of how any of these characters will work in a fighting game context. Thus, my goal is to just mess around with these fighters with some friends and figure out if there’s a character or two I really gravitate toward. In most fighting games, it’s not usually a specific predetermined playstyle that pulls me in, but rather I just find characters I like and adapt to playing them. It’s why I play a brawler like Akihiko in Persona 4 Arena Ultimax but a range-based character like Green Arrow in Injustice 2. So who knows who I’ll end up maining in 2XKO? — Kenneth Shepard

Across the vast and seamlessly connected planet of Kairos, players will face the oppressive Timekeeper. For thousands of years, he kept the planet hidden, controlling its inhabitants with cybernetic implants called Bolts and an army of synthetic soldiers known as The Order.

Players will travel across the planet where they’ll encounter new and returning characters, creatures and inhabitants to battle, and unique factions spread across four distinct regions that seek freedom from tyranny. The friends discovered along the way will be recruited by players to their cause, while enemies will experience first-hand the arsenal of weapons and abilities wielded by the Vault Hunters.

Borderlands 4 is the boldest Borderlands to date, lovingly handcrafted by the development studio that first forged the looter-shooter genre. The title evolves the series’ gameplay and storytelling in new ways, while delivering on the quintessential Borderlands experience fans know and love, including:

Maurice’s Black Market Vending Machine is one of Borderlands 4’s most exciting endgame features, but it comes with a catch: the machine never stays in one place.

Every week it shifts to a brand-new location, and unless you track it down, you’ll miss out on exclusive Legendary loot. That makes it a bit of a scavenger hunt, and one that can be tricky if you’re not sure where to start.

If you’ve already beaten the main story and unlocked Maurice’s machine, you’re ready to join the search.

Maurice’s Black Market Vending machine location

From September 12 to September 18, Maurice’s Black Market Vending Machine can be found in Plungeford, a small location in the northern part of Coastal Bonescape. It’s positioned just southwest of The Launchpad, making that your best fast travel point if you want to get there quickly.

Once you arrive in Plungeford, be prepared for resistance. The area is swarming with Rippers, so you’ll need to clear them out before you can interact with the vending machine.

The machine itself is on the balcony of the tallest building in the area, slightly beyond the checkpoint respawn point. Just be aware that it looks almost completely invisible from afar; you’ll need to get close to actually see it properly.

The machine will remain in this location until the weekly reset, which happens every Thursday at midnight EDT. After that, it will vanish and reappear in a new spot, so make sure to visit before the rotation.

How to unlock Maurice’s Black Market Vending Machine

Maurice’s vending machine isn’t available from the start of the game. To unlock it, you’ll first need to complete Borderlands 4’s main story campaign, which usually takes around 30 hours.

Once the credits roll, you’ll gain access to Ultimate Vault Hunter Mode (UVHM), which introduces several new missions tied to the game’s endgame.

The vending machine is first introduced in the mission Ultimate Vault Hunter: Maurice’s Bounty. This quest tasks you with tracking down the Black Market for the first time and claiming a reward from it.

After completing this mission, Maurice’s machine will become part of the open world, rotating to a new location every week.

When you get close to the machine, it will appear slightly invisible until you are within about twenty meters.

Once it fully materializes, a map marker will be placed, helping you find it again until the reset. You can also track the timer for Maurice’s weekly moves through the Weekly Activities menu, which lists how long remains before the next relocation.
